23. 01-2012 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner has been arrested in connection with Brahampur P.S. Case No. 188 of 2011, registered for offence under Sections 447, 504, 379, 385 and 387/34 of the Indian Penal Code. The occurrence took on the pretext that the petitioner along with three others came to the shop of the informant and asked the servant of the informant to get tight the chain of the motorcycle. However, the servant of the informant shows his inability. It is also alleged that accused persons took the ceiling fan from the shop of the informant and they demanded Rs. 5,00,000/- as Rangdari. Learned counsel for the petitioner submits that allegation about demand of Rs. 5,00,000/- from the informant Patna High Court Cr.Misc. No.3300 of 2012 (2) dt.23-01-2012 appears to be absurd as shop of the informant is motorcycle repairing shop and the petitioner is in custody since 07. 12.2011. However, learned court below observed that there is criminal antecedent against the petitioner. Under the facts and circumstance of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Brahampur P.S. Case No. 188 of 2011, subject to the condition that petition shall file Hajri in the nearest police station once in a week. (Gopal Prasad, J.) m.p.
