IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.3427 of 2012 Amit Kumar @ Dhipha Versus The State Of Bihar ---------------------------------- 2/ 23/01/2012 Heard learned counsel for the petitioner. State is none presented. Meena Devi filed a written report disclosing therein that his son, Bijo Paswan who was an addict and on account thereof was not carrying good mental condition was missing since 26.7.2011. Subsequently, Chaukidar had informed that he is lying in unconscious condition. She rushed to P.O. and found her son dead. She had not shown any kind of suspicion against anybody. Admittedly, petitioner is not named. From the learned lower court record, it is evident that witnesses have come forward to support the case of last seen theory. However, close proximity of time in between is missing. In the aforesaid facts and circumstances of the case, petitioners Amit Kumar @ Dhipha is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction 2 of Chief Judicial Magistrate, Begusarai in connection with Sadar (Mufassil) P.S.
