patna high court cr.misc. no.39364 of 2011 (3) dt.23-01-2012 in the high court of judicature at patna criminal miscellaneous no.39364 of 2011 ====================================================== raju sao .... .... petitioner versus the state of bihar .... .... opposite party ====================================================== appearance : for the petitioner : mr. rajeev ranjan ii for the opposite party : mr. pradip nr. kumar, a.p.”23. 01-2012 heard learned counsel for the petitioner as well as learned addl. public prosecutor for the state. petitioner is in jail custody since 6.6.2011 in a case registered under sections 20, 22, 23 and 24 of the ndps act. admittedly, alleged recovery has been made from the dicky of the bus and the same has not been recovered from the conscious possession of the petitioner. it is also admitted position that as per prosecution case, informant has not seen the petitioner keeping the seized article in the dicky of the bus and he reached at the place of the occurrence having got information from one ptc 5.ashok singh, the statement of the aforesaid ptc 5.ashok singh has not been recorded by the investigating officer in course of investigation. considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, rajo sao, be released on bail on furnishing bail bonds of rs 10,000/- with two sureties of the like amount each to the satisfaction of the addl. sessions judge xi, patna in special case no. 23/2011 arising out of jakkanpur p.s. case no. 158/2011.
