The petitioner is in custody in connection with Civil Lines P.S. Case No. 219 of 2011 for the offence punishable under Sections 413 and 414 of the Indian Penal Code. Learned counsel for the petitioner, with reference to the F.I.R. submits that admittedly the stolen motorcycles were not recovered from the petitioner rather the involvement of the petitioner is on the basis of the statement made by co-accused Suraj Kumar who has stated that he had obtained the stolen motorcycle from this petitioner and as a consequence whereof the petitioner was arrested from his house. Learned counsel for the petitioner, with reference to orders passed in Criminal Misc. No. 35721 of 2011 (Anurag Sinha @ Anshu Vs. State) and Criminal Misc. No. 38158 of 2011 (Pradeep Kumar Vs. State), submits that two of the accused who were apprehended with the stolen motorcycles, have since been released on bail by a bench of this Court. Patna High Court Cr.Misc. No.44452 of 2011 (2) dt.23-01-2012 Regard being had to the submission of learned counsel, let the petitioner Dharmendra Ravidas be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S.
