IN THE HIGH COURT OF JUDICATURE AT PATNA First Appeal No.177 of 1983 Ramayan Pandey & Anr Versus Ram Pravesh Pandey & Ors ---------------------------------- 23. 23.01.2012 Perused the office note dated 18.1.2012. It appears that by terms of order dated 16.1.2012 when the office note was placed that the appeal has been dismissed against the respondent Nos. 1, 3 to 7 therefore, whether the appeal will proceed or not, this Court directed that the incompentency matter may be considered at the time of final hearing of the appeal. Today the office has pointed out that the respondent Nos.2 and 8 to 10 have already died and as far back as on 5.2.2001 the appellants were directed to take steps for substitution but it has not been taken. Therefore, now there is no respondent at all in this appeal. In such view of the matter, the whole appeal has now become incompetent, as such it is dismissed. S.S. (Mungeshwar Sahoo, J.)
