23. 01-2012 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State, who is armed with carbon/xerox copy of the case diary up to paragraph 55 dated 30/11/2010. The petitioner is apprehending his arrest in connection with a case registered for the offence punishable under Sections 420, 467 and 468 of the Indian Penal Code. In this case, instituted against one Vijay Tiwari, petitioners name emerged during investigation in the extra judicial confession of one Awanind Kumar Sharma an employee in the shop of the petitioner. Submission is that even in the said extra judicial confession, there is nothing against the petitioner, though 2 Patna High Court Cr.Misc. No.40737 of 2011 (3) dt.23-01-2012 2/2 someone else utilized phone numbers, passwords etc. Further, it is also submitted that there is no corroborating material against the petitioner, who has also no criminal antecedent.
