Opposite Party. ---------------------------------- 02/ 23.01.2012 Heard learned counsel for the petitioner and learned counsel for the State. This is a petition for grant of regular bail for the offence under Sections 401 and 420/34 of the Indian Penal Code. The petitioner and others were caught while they were fleeing away. On secret information to the police that there is a gang of criminals operating in the train, who took out the briefcase and bag of the travelers. However, out of the three persons a black coloured bag having two seals and a mobile were recovered from the possession of Gopal Singh. However, it is stated that nothing was recovered from the possession of this petitioner and the petitioner is in jail since 11.08.2011. However, there is one another case against the petitioner. However, the petitioner has got criminal antecedent. Hence, having regard to the facts and circumstances of the case, the above named petitioner is 2 directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Sonepur in connection with Sonepur/Hajipur Rail P. S. Case No. 54 of 2011, subject to the condition that the petitioner shall file Hazari in the nearest police station i.e. Hajipur Sadar Police Station during the pendency of this case.
