23. 01-2012 Both the above-said Cr. Misc. Cases arise out of Town P.S. Case No. 76 of 2010 registered under Section-396 of the IPC and accordingly, both the above- said petitions are being disposed of by this common order. Counsel for the petitioner in Cr. Misc. No. 38655 of 2011 is permitted to make necessary correction in the prayer portion in course of the day. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report but their name came in this case in course of investigation and, allegedly, some looted mobiles were recovered from the house of petitioner in Cr. Misc. No. 38655 of 2011 but learned counsel appearing for the aforesaid petitioner drew my contention towards Paragrph-114 of the case diary and submitted 2 that the seized mobiles are not looted property of the present case. Taking into consideration the above-said submissions as well as this aspect of the matter that having more or less similar allegation, some co-accused persons have already been granted privilege of bail, let the petitioners, namely, Pawan Yadav (in Cr. Misc. No. 38655 of 2011) and Bhikhari Sahni (in Cr. Misc. No. 39982 of 2011) be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sessions Trial No. 485 of 2010 arising out of Town P.S. Case No. 76 o”
