in the high court of judicature at patna criminal miscellaneous no.28810 of 2010 ====================================================== birendra kumar gupta & ors .... .... petitioners versus state of bihar .... .... opposite parties ====================================================== appearance : for the petitioner/s : mr. s.n.p.sinha, sr.advocate for the opposite party/s : mr. ====================================================== coram: honourable mr. justice vikash jain oral order (per: honourable mr. justice vikash jain”23. 01-2012 learned senior counsel mr. s. n. p. sinha appearing on behalf of the petitioners has filed a supplementary affidavit, inter alia, enclosing a certificate of bihar state financial corporation, purnea showing that the entire outstanding has been cleared under the one time settlement scheme-2009 against m/s. bihar steel products, maranga, district purnea. he, therefore, submits that there is no occasion to continue the prosecution against the petitioner. learned counsel for the petitioners is permitted to implead bihar state financial corporation, purnea as opposite party no.2. issue notice to the newly added o.p. no. 2 both by registered cover with a.d. as also by ordinary process for which requisites etc., must be filed within two weeks, failing which this application shall stand rejected against the concerned opposite party without further reference to bench. in the meantime, further proceedings in cr. rev. no. 296 patna high court cr.misc. no.28810 of 2010 (2) dt.23-01-2012 2/2 of 2002/tr. no. 32 of 2003 in connection with k .hatt p.s.case no. 37 of 1995 pending before the learned court below shall remain stayed.
