The petitioner is in custody in connection with N.D.P.S. Case No. 36 of 2010 arising from Raxaul P.S. Case No. 09 of 2006 for offence punishable under Sections 20, 22, 23 and 24 of the N.D.P.S. Act Taking into consideration the submission of learned counsel that even in absence of any recovery and in absence of criminal antecedent, the petitioner has been arrested in the present case merely by reason of statement made by the persons apprehended with the contraband with allegation that the petitioner is also engaged in the business of illegal acts, let the petitioner Nurain Mian be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Patna High Court Cr.Misc.
