IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.3548 of 2012 Munna Kumar Versus The State Of Bihar ---------------------------------- 02. 23.01.2012. Heard learned counsel for the petitioner and learned Additional P.P. for the State. 1100 litres of kerosene oil was seized from Tata Magic bearing registration no.BR-1AM-9379 over which petitioner was also present and accordingly he along with driver has been booked. However, it has been disclosed by them that the aforesaid kerosene oil was purchased from one Master Jee for Rs.26,000/-. It has been submitted on behalf of the petitioner that he was mere a passenger without having any access with regard to kerosene oil whatever been seized. Also submitted that the aforesaid theme is also evident from the seizure list which did not encircle the petitioner so far seizure is concerned.
