in the high court of judicature at patna criminal miscellaneous no.37398 of 2011 ====================================================== rajesh yadav, son of jagdish yadav. .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== coram: honourable mr. justice akhilesh chandra oral order (per: honourable mr. justice akhilesh chandra”23. 01-2012 heard learned counsel for the petitioner and learned additional public prosecutor for the state, who is armed with carbon/xerox copy of the case diary up to paragraph 321 dated 25/08/2009. the petitioner is apprehending his arrest in connection with ghanshyam pur p.s. case no. 2 of 2008 for the offence punishable under sections 364(a), 379, 120(b) of the indian penal code, pending in the court of judicial magistrate, 1st class, beraul at benipur (darbhanga). after some arguments, learned counsel for the petitioner seeks permission to withdraw this application with a liberty to surrender before the court below within a fortnight for a prayer of regular bail, which shall be considered on its own 2 patna high court cr.misc. no.37398 of 2011 (3) dt.23-01-2012 2/2 merit without being prejudiced of instant withdrawal. permission is granted. accordingly, this application stands disposed of as withdrawn.
