23. 01-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Section 414/34 of the Indian Penal Code. A supplementary affidavit has been filed that after three years of the lodging of the F.I.R., one of the co-accused named this petitioner that he bought the alleged motorcycle from the petitioner. Supplementary affidavit further stipulates that the investigation is still pending against the petitioner whereas other F.I.R. named accused persons have been charge sheeted and the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like Patna High Court Cr.Misc. No.1803 of 2012 (2) dt.23-01-2012 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 57 of 2006 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J.) Amrendra/-
