patna high court cr.misc. no.2564 of 2012 (2) dt.25-01-2012 in the high court of judicature at patna criminal miscellaneous no.2564 of 2012 ====================================================== raju kumar gupta .... .... petitioner. versus the state of bihar through c.b.i. .... .... opposite party. ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”25. 01-2012 heard mr. ajay kumar thakur, learned counsel for the petitioner and mr. bipin kumar, learned counsel for the c.b.i. this is third attempt on behalf of petitioner for getting the anticipatory bail in a case registered for the offence under sections 120b, 420, 467, 468, 471 of the indian penal code and section 13(2) read with 13(1)(d) of the prevention of corruption act. the accusation was of preparing fake and fabricated bills by forging the signature of competent authority against supply of the materials for which no order was passed by b.s.n.l. it is submitted that others have been granted anticipatory bail in the matter on depositing of the alleged amount against them. this court is not inclined to consider patna high court cr.misc. no.2564 of 2012 (2) dt.25-01-2012 anticipatory bail of petitioner. however, let the learned court below consider regular bail of petitioner considering the fact that others have been granted bail on depositing of the alleged amount against them. with this observation, this anticipatory bail application in connection with special case no. 18/05 arising out of r.c. case no. 15(a)/05 pending in the court of the learned special judge, c.b.i.,iii, patna, is disposed off. let the order be faxed to the learned court below at the cost of petitioner.
