in the high court of judicature at patna criminal miscellaneous no.2546 of 2012 ====================================================== suresh prasad .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”25. 01-2012 petitioner is apprehending his arrest in a case registered for the offences under section 7 of the essential commodities act. it is alleged that petitioners sons shop was inspected when 3.35 quintal of wheat and 25.2 quintal of rice were seized and some of the bags were having marking of f.c.i. and s.f.c. it is submitted by learned counsel for the petitioner that it is well settled principle that only because of the f.c.i. marking does not connote the grains belonging to the f.c.i. and admittedly the raid was made on the shop of the son of the petitioner. considering the aforesaid facts, let the petitioner namely suresh prasad, in the event of his arrest or surrender before the court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing 2 patna high court cr.misc. no.2546 of 2012 (2) dt.25-01-2012 2/2 bail bond of rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned s.d.j.m., patna in connection with gardanibagh p.s. case no. 248 of 2011.
