in the high court of judicature at patna criminal miscellaneous no.2812 o”1. sushila devi w/o girish prasad, 2. girish prasad s/o late mahendra prasad both are resident of village rauna sherpur, p.s. belaganj, district gaya. versus 1. the state of bihar 2. the branch manager, bank of baroda, kankarbagh branch, patna. ----------- 2. 25.1.2012. a prayer for modification of the order dated 20.7.2011 passed in cr.misc. no.23699 of 2011 has been made. by the aforesaid order the petitioners were granted provisional anticipatory bail for the period of four months on an undertaking that in the meantime they would make payment of entire principal amount of loan advanced by the bank. admittedly, the petitioners have failed to comply with the undertaking given to the court. in that view of the matter, i find no reason to modify the order dated 20.7.2011 passed in cr. misc. no.23699 of 2011. this application is, accordingly, rejected. the registry is directed to communicate the order immediately to the court below through fax. md.s.
