25. 01-2012 Heard learned counsels for the petitioner and the State. The petitioners are apprehending their arrest in connection with Malsalami P.S. Case No. 139 of 2010 registered under Sections 341, 324, 326 and 307/34 of the Indian Penal Code pending in the court of learned Additional Chief Judicial Magistrate, Patna City. It is alleged that the petitioners along two other accused persons assaulted the informant. It is submitted by learned counsel for the petitioners that one of the three accused persons has been granted regular bail by learned court below. 2 Patna High Court Cr.Misc. No.2255 of 2012 (2) dt.25-01-2012 2/2 I see no reason for the learned court below not to give the same privilege to the petitioners, preferably on the same day if the petitioners surrender within a period of six weeks. With the above observation, this application is, accordingly, disposed off. Let the order be transmitted to the learned court below through FAX at the cost of the petitioners.
