patna high court cr.misc. no.2521 of 2012 (2) dt.25-01-2012 in the high court of judicature at patna criminal miscellaneous no.2521 of 2012 ====================================================== shankar yadav .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”25. 01-2012 petitioner is apprehending his arrest in a case registered for the offences under sections 147, 148, 323, 307, 302 of the i.p.c. petitioner was not named in the f.i.r. and the police got the warrant issued against the petitioner in 2006 when the case was instituted in 1997. it appears from the impugned order that learned sessions judge has not interfered since the police has not taken any step for issuance of warrant against the petitioner and the main case being sessions trial no. 8/99/372/98 have already been disposed off which is elaborated in para 16 and 17 of the petition. considering the aforesaid facts, let the petitioner namely shankar yadav, in the event of his arrest or surrender before the court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of rs. 10,000/-(ten thousand) with two sureties of patna high court cr.misc. no.2521 of 2012 (2) dt.25-01-2012 the like amount each to the satisfaction of learned chief judicial magistrate, gaya in connection with fatehpur p.s. case no. 42 of 1997. let superintendent of police, gaya submit a report to the learned court below as under what circumstance the case has been kept pending against the petitioner till date.
