25. 01-2012 Heard learned counsel for the petitioner and learned counsel for the State. This application has been filed for quashing the order dated 3.2.2010 passed in Kishanganj P.S. Case No.185 of 2008 by the Chief Judicial Magistrate, Kishanganj by which the learned Magistrate has taken cognizance against the petitioner under sections 414, 419/34 of the Indian Penal Code and 11(1)(d) of the Prevention of Cruelty to Animal Act. Learned counsel for the petitioner submits that the police has intercepted a truck bearing registration no. BR- 06-D/3123 having 17 heads of bullocks coming from Dalkola and going towards Islampur and on enquiry the Patna High Court Cr.Misc. No.273 of 2011 (2) dt.25-01-2012 police seized 17 heads of cattle. He has further submitted that on asking for documents with regard to purchase of cattle the petitioner could not produce any document and a seizure list was prepared. The petitioner claims that the cattle were purchased by him. At this stage this Court is not inclined to interfere with the impugned order. This application is dismissed with a liberty to raise all the points before the trial court at the appropriate stage. (Shivaji Pandey, J.) Vinay/-
