25. 01-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 302 and 201/34 of the Indian Penal Code. An F.I.R. was lodged under Section 302 of the IPC when husband of the informant did not return and after two days of the occurrence his dead body was found floating in the river then suspicion was raised against the petitioners being the agnates of the informant. It appears that post mortem report reflects no external injury and cause of death was opined by the doctor as exposure due to sun stroke. Similar is the evidence of doctor who was examined in the trial of co-accused against whom charge sheet was submitted earlier and investigation is pending Patna High Court Cr.Misc. No.2370 of 2012 (2) dt.25-01-2012 2/2 against the petitioners. Considering the aforesaid facts, other similarly situated accused persons have been granted bail vide Cr. Misc. No. 42505 of 2011. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra In connection with Janta Bazar P.S. Case No. 69 of 2010 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J.) Amrendra/-
