25. 01-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code. The accusation is of non-disbursement to the amount to the beneficiaries whose crops were damaged by flood. It is submitted that the petitioner is the Circle Inspector and he was not member of the committee and was not authorized to disburse the amount. The F.I.R. was lodged by a private person. Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kumarkhand P.S. Case No. 162 of 2011 on furnishing bail bond Patna High Court Cr.Misc. No.2567 of 2012 (2) dt.25-01-2012 of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J.) U.K./-
