patna high court cr.misc. no.2950 of 2012 (2) dt.25-01-2012 in the high court of judicature at patna criminal miscellaneous no.2950 of 2012 ====================================================== sujay pandey, son of sri ramanand pandey, resident of village- bangri, p.s. piprakothi, district- east champaran. .... .... petitioner. versus the state of bihar .... .... opposite party. coram: honourable mr. justice gopal prasad oral order (per: honourable mr. justice gopal prasad”25. 01-2012 heard learned counsel for the petitioner and learned counsel for the state. the petitioner has been arrested in connection with motihari town p.s. case no. 63/08, registered under section 302/34 of the indian penal code and section 27 of the arms act. it is alleged that at the jail gate muslim mian and umesh sahani exploded bomb and mauze lal sahani fired by which munna got injured and sanjay mukhiya and krishna giri shot the informant on the back of the head. it is further alleged that this petitioner along with others ran to catch hold the informant and hence only allegation against the petitioner that he ran to catch hold of the informant. the petitioner is in custody since 21. 09. 2008. having regard to the facts and circumstances of the case, the above named petitioner is directed to be released patna high court cr.misc. no.2950 of 2012 (2) dt.25-01-2012 on bail on furnishing bail bond of rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the chief judicial magistrate, east champaran, motihari, in connection with motihari p.s. case no. 63 of 2008, subject to conditions that one of the bailors shall be close relative of the petitioner and petitioner shall appear in this case on each and every date fixed by the court below and in any absence subject to reasonable ground to the satisfaction of the court below.
