patna high court cr.misc. no.38118 of 2011 (3) dt.19-01-2012 in the high court of judicature at patna criminal miscellaneous no.38118 of 2011 ====================================================== sharda devi, w/o-ashok tiwary .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== ====================================================== coram: honourable mr. justice hemant kumar srivastava oral order (per: honourable mr. justice hemant kumar srivastava”19. 01-2012 heard learned counsel for the petitioner as well as learned additional public prosecutor for the state. petitioner being lady is languishing in jail custody since 12.08.2011 in a case registered under sections 394 of the indian penal code and 25(1-b)a, 26 of the arms act. the contention of learned counsel for the petitioner is that the case has been lodged with exaggerated story and, as a matter of fact, the petitioner had gone to the clinic of the informant in connection with her treatment and so far as recovery is concerned, according to prosecution case itself, the same has not been recovered from conscious possession of the petitioner. considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of rs. patna high court cr.misc. no.38118 of 2011 (3) dt.19-01-2012 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of chief judicial magistrate, gaya in connection with moffasil p.s. case no. 155 of 2011.
