IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.40295 of 2011 Rajesh Yadav Versus The State Of Bihar ---------------------------------”

19. 01-2012 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner, being husband of the deceased, is in jail custody since 25-03-2011 in a case registered under Sections-304B, 201/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. Learned counsel for the petitioner submits that the deceased met with a train accident, as a result of which, she died but informant under misconception, lodged the present case. It is further contended by him that when the informant came to know about the real fact, he stated before the trial court that the deceased died accidentally. It appears from perusal of the impugned order as well as submission of the parties that the trial of the petitioner is going on and, therefore, I am not inclined to release the petitioner on bail, at least, at this stage. Accordingly prayer for bail of the petitioner in connection with Rivilganj P.S. Case No. 124 of 2010 corresponding to Sessions Trial No. 487 of 2011 pending 2 in the court of Additional Sessions Judge-III, Saran at Chapra is, hereby, rejected. However, trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible. ( Hemant Kumar Srivastava, J.) AKVishwakarma
