11. 01.2012 Heard learned counsels for the petitioner and the State. By order dated 26.03.2011 passed in Cr. Misc. No. 2957 of 2010 it was directed that in the event of arrest of surrender of the petitioner within a period of four weeks, petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount. Petitioner did not surrender and filed an application for modification of the aforesaid order vide Cr. Misc. No. 27047 of 2011. Considering the submissions the initial time allowed was extended by another period of three weeks vide order dated 17.08.2011. Petitioner again did not surrender. Learned counsel appearing for the petitioner submits that since the matter was amicably resolved between the husband and the wife and they are living together happily, in bonafide mistake, the petitioner, who was working in Punjab, could not surrender. Considering the submissions of the parties, the time allowed for surrender is extended by another three weeks from today in connection with Sahar P.S. Case No. 55 of 2009. The orders dated 26.03.2011 and 17.08.2011 passed in Cr. Misc. Nos. 2957 of 2010 and 27047 of 2011 respectively are modified to the above extent. The Cr. Misc. application accordingly stands disposed of. Let the orders dated 26.03.2011 and 17.08.2011 passed in Cr. Misc. Nos. 2957 of 2010 and 27047 of 2011 respectively along with the present order be communicated to the Court of Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S. Case No. 55 of 2009 through FAX on the cost being deposited by the petitioner. Manish/- ( Shailesh Kumar Sinha,J.)
