IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Revision No.1268 of 2011 Ramdeo Sah Versus The State of Bihar & Ors. ---------------------------------- 3. 11.01.2012 I.A. No. 2142 of 2011 Learned counsel for the petitioner, learned counsel for opposite parties no. 2 and 3 and learned A.P.P. for the State are present. The I.A. has been filed for condonation of delay of about one and a half months in filing of the present revision application. For the reasons mentioned in the I.A. the delay in filing of the revision application stands condoned. The I.A. accordingly stands allowed. By order dated 17.10.2011 notice was issued both in the limitation as well as in the admission matter. Accordingly, the case is also heard on the point of admission. This application is directed against the part of the order dated 26.5.2011 passed in Maintenance Case No. 14 of 2009 by the Principal Judge, Family Court, Muzaffarpur by which he has held that only opposite party no. 3 shall pay Rs. 2,000/- per month to the petitioner. This application shall be heard. Call for the lower Court records from the Court of Principal Judge, Family Court, Muzaffarpur in 2 connection with Maintenance Case No. 14 of 2009. During pendency of the application the opposite parties no. 2 and 3 shall each pay a sum of Rs. 2,500/- per month i.e., totalling Rs. 5,000/- per month to the petitioner. The same should be paid latest by 7th of the subsequent month in cash. The opposite parties no. 2 and 3 shall also contribute with regard to the expenses incurred for the treatment of the petitioner and his wife, that is, mother of opposite parties no. 2 and 3, in view of the fact that their employment also carries the benefit of medical treatment to the dependant parents.
