in the high court of judicature at patna criminal miscellaneous no.1568 of 2012 ashok singh & shanti singh versus the state of bihar ---------------------------------- 02. 11.01.2012. heard learned counsel for the petitioners and learned counsel appearing on behalf of the state. the petitioners apprehend their arrest in connection with a case under sections 147, 148, 149, 323, 337, 427, 341 and 307 of the indian penal code and section 3(i)(x)of the sc/st (prevention of atrocities) act. it is contended that the petitioners have no criminal antecedent. there is no specific allegation against them. the specific allegation is as against jagan singh who is said to have assaulted ran awadh ram by spade. said jagan singh has already granted anticipatory bail by order dated 29.08.2011 passed in cr.misc.no.26263 of 2011 by another bench of this court. similarly co-accused binod singh, subhas singh, pappu singh, guddu singh, harihar singh, praveen kumar @ pravash kumar and jhinguri singh have also been granted anticipatory bail by order dated 30.06.2011 passed in cr.misc.no.19435 of 2011 by 2 another bench of this court. considering the facts and circumstances of the case and also taking into account the reasonings assigned in the aforesaid two orders granting anticipatory bail to co-accused persons, let the petitioners, namely, ashok singh and shanti singh in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/communication of this order, be released on bail on furnishing bail bonds of rs.5,000/-(five thousand)each with two sureties of the like amount each to the satisfaction of the chief judicial magistrate, rohtas, sasaram in connection with karaghar(barahari)p.s.case no.42 of 2011, subject to the condition as laid down under section 438(2)of the cr.p.c. b.kr.
