in the high court of judicature at patna miscellaneous jurisdiction case no.3038 of 2011 vishwanath singh & ors versus the state of bihar & ors ---------------------------------”11. 1.2012 heard learned counsel for the petitioner and the counsel appearing on behalf of the state. the controversy now rests and centers around the fact whether the petitioner would be entitled to get the pay scale of the headmaster from the year 1996 or from the year 2004. the petitioner was granted promotion in 2004 w.e.f. 1996. the claim of the petitioner is that other juniors to him have been granted promotion and the pay scale from 1996 whereas the petitioner has not been given the same benefit. it is an accepted fact that the petitioner has joined on the post of headmaster in the year 2004 and he had never worked on the post of headmaster before that. this fact should be examined afresh by the district education officer, bhojpur at arrah and pass appropriate order by 17.2.2012. list this case for admission on 29.2.2012. in the mean time, the affidavit should be served on the counsel for the petitioner. sanjay (sheema ali khan, j.)
