Mr. Dr. Parsuram Bharti, son of not known to the petitioner, the Civil Surgeon-cum-Chief Medical Officer, Aurangabad. ----- Opposite parties. ---------------------------------- 2. 11.01.2012 Heard learned counsel for the petitioner and learned counsel for the Opposite parties. The petitioner has prayed for initiation of contempt against the Opposite parties for non-compliance of the order dated 6.10.2009 passed in C.W.J.C. No. 1418 of 2009. A show cause has been filed on behalf of the Opposite Party No. 7 i.e. Civil Surgeon-cum-Chief Medical Officer, Aurangabad, annexing an order passed in L.P.A. No. 712 of 2010. The said L.P.A. was preferred by the State of Bihar and other Officials and the petitioner was named as a Respondent. The order dated 19.4.2010 reveals that an order was passed in terms of an earlier writ application after having heard the counsel for the 2 Respondent Mr. Gajanand Arun. The counsel for the State points out that despite the concession given by the Respondents-Opposite Parties before the L.P.A. he chose not to appear before the one man committee and, therefore, his case could not be considered by the one man committee. At this juncture, the counsel for the petitioner submits that fact of the matter is that the petitioner had never made an appearance before the L.P.A. Court nor had he executed a Vakalatnama in favour of Mr. Gajanan Arun who is mentioned to have appeared on his behalf in the order dated 19.4.2010. In light of the aforesaid, the petitioner prays for withdrawal of this application to move the L.P.A. Court for his redressal. In view of such submissions, the application is permitted to be withdrawn. ( Anjana Prakash, J.) S.Ali
