1. Md. Naseem @ Naseem Mian, 2. Meharun Khatoon Versus The State Of Bihar & Anr ---------------------------------- 2/ 11.1.2012 Heard learned counsels for the petitioners and the State. The petitioner no. 1 being the husband and petitioner no. 2 being mother of petitioner no. 1 are apprehending their arrest in Complaint Case no. 649 of 2010 in which cognizance has been taken under section 498A of the Indian Penal Code pending in the court of J.M. Ist Class, Sherghati, Gaya. Petitioner no. 1 is ready to keep his wife with full dignity and honour. Seeing the stand of petitioner no. 1, let the above named petitioner no. 2 be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of Rs.10000/(ten thousand) with two sureties of the like amount each to the satisfaction of J.M. Ist Class, Sherghati, Gaya in the abovementioned complaint case subject to the conditions as laid down under section 438(2) of the Cr.P.C. So far as petitioner no. 1 above named is concerned, let he be released on provisional anticipatory bail for one year in the event of his arrest or surrender before the learned court below within a period of twelve weeks from 2 today, on furnishing the bail bond of Rs.10000/(ten thousand) with two sureties of the like amount each to the satisfaction of J.M. Ist Class, Sherghati, Gaya in the above mentioned complaint case subject to the conditions as laid down under section 438(2) of the Cr.P.C. Let the learned court below issue notice to the complainant for her appearance when the petitioner no. 1 will take the complainant to her matrimonial house to keep her as wife with full dignity and honour. The provisional bail of the petitioner no. 1 will be confirmed by learned court below within a period of one year on substantial restoration of the matrimonial harmony or if the complainant deliberately refuses to reside with the petitioner no.
