Dev Narayan Mandal son of late Neti Mandal 2.Buchiya Devi wife of Dev Narayan Mandal 3.Sanjay Mandal son of Dev Narayan Mandal All residents of village-Ragopur Tola-Gadi, P.S.-Raghopur, District- Supaul. Versus The State Of Bihar ----------- 2. 11.1.2012. Heard learned counsel for petitioners and learned counsel for the State. The petitioners apprehend their arrest in connection with a complaint case in which cognizance has been taken for the offence punishable under sections 323, 379, 380, 452, 504 and 34 of the Indian Penal Code. It is submitted that the petitioners have falsely been implicated in this case. The allegation is omnibus and general in nature. The petitioners are co-villagers. Petitioner no.1 Dev Narain Mandal had instituted Complaint Case No. 328C of 2006 against the complainant prior to institution of the present case and petitioner no.2, Buchiya Devi, is his wife whereas petitioner no.3, Sanjay Mandal, is his son. Taking into consideration the nature of allegation and facts and circumstances of the case let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/communication of the order be released on bail on furnishing bail bonds of Rs.5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned 2 S.D.J.M., Birpur, Supaul in connection with Complaint Case No.350 of 2006 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
