Heard Shri Yogesh Chandra Verma, learned Senior Counsel for the petitioners and Shri Pawan Kumar Chaurasia, learned Additional Public Prosecutor. The petitioner has prayed for quashing of order dated 7.12.2010 passed in Complaint Case No.498/10/Tr. No.2653/2010 passed by the Judicial Magistrate, Ist Class, Nawada, whereby the court below has taken cognizance for the offence under sections 406, 420, 323/34 of the Indian Penal Code. Issue notice to opposite party no.2 to file show cause as to why this petition be not disposed of at the stage of admission itself. Notice to go through ordinary post as well as registered cover with A/D, for which requisites etc. must 2 be filed within ten days, failing which this application shall stand rejected without further reference to a Bench. In view of the facts and circumstances, the court is of the opinion that there shall be stay of operation of order dated 7.12.2010 so far as petitioners are concerned.
