IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.44687 of 2011 Santosh Das, S/O-Rajendra Das Versus The State Of Bihar ---------------------------------”

12. 01.2012 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, the victim has already been returned to her home safely and she has stated in her statement recorded under Section 164 of the Cr.P.C. that she was forcibly taken away by co- accused Rajesh Kumar and the petitioner helped the aforesaid Rajesh Kumar in committing the alleged crime. Learned counsel for the petitioner points out that, as a matter of fact, there was love affair between co-accused Rajesh Kumar and the victim and after the alleged occurrence victim as well as aforesaid Rajesh Kumar were caught by the police.
