IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.931 of 2012 Pramod Prasad Versus The State Of Bihar ---------------------------------- 02. 12.01.2012 Petitioner being fertilizer dealer is apprehending his arrest in a case registered for the offences under Sections 420, 406 of the I.P.C. and Section 3(iii) of the Fertilizer Control Act. It is alleged that instead of 93 bags only 86 bags of fertilizer were found in the stock. It is also alleged that petitioner was selling fertilizer at higher price than the prescribed price. It is submitted by learned counsel for the petitioner that inspection was made in the afternoon and no consumer has made accusations as levelled in the F.I.R. and the license of the petitioner has already been suspended. Considering the nature of accusation and the fact that fertilizer dealer license of the petitioner has been suspended, let the petitioner namely Pramod Prasad, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Phulwaria P.S.
