IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.947 of 2012 Nand Kishore Sharma & Ors. Versus The State Of Bihar 2. 12.01.2012. Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 447, 448, 384, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act. The accusations are of entering into the house of the informant, making extortion of demand and resorting to firing which hit on the wall. It is submitted by learned counsel for the petitioners that during investigation the accusation was found false and final form was submitted but differing with the same cognizance has been taken against the petitioners. It is further submitted that there is land dispute between the parties and probate case is also going on for the land dispute. Considering the aforesaid facts, let the petitioners, Nand Kishore Sharma, Brij Kishore Sharma, Durgesh Kumar, and Montu Sharma, be released on bail in the 2 event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kurtha (Manikpur)P.S. Case No. 165 of 2008 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Jehanabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U. K. ( Dinesh Kumar Singh, J)
