IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Revision No.1970 of 2009 Subhash Bhagat Versus The State of Bihar & Anr. ---------------------------------- 4. 12.01.2012 Learned counsel for the petitioner and learned A.P.P. for the State are present. This application has been filed for setting aside the order dated 4.5.2009 passed in Complaint Case No. 748 (C)/2007 by the Judicial Magistrate, 1st Class, Supaul by which he has taken cognizance under Sections 376, 323 and 450 of the Indian Penal Code. Learned counsel for the petitioner submits that earlier the complaint petition has been dismissed under Section 203 of the Code of Criminal Procedure by the same Court.
