IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.44647 of 2011 Dr. Nikhil Kumar Versus The State Of Bihar ----------- 02/ 12.01.2012 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is in jail custody in a case registered under sections 304A, 504 of the IPC and 3(I-X) of the SC/ST (Prevention of Atrocities) Act. Allegation against the petitioner is that he did not provide proper treatment to the husband of the informant and also humiliate her by calling her castes name. The contention of learned counsel for the petitioner is that petitioner was not on duty when the deceased was admitted in the hospital and subsequently, in the next morning petitioner left hospital at 8 a.m. and after that the deceased died at 8.10 a.m. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, Dr. Nikhil Kumar, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Town P.S.
