IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Revision No.3 of 2012 Manish Kumar Singh S/O Satendra Kumar Singh Resident Of Village- Fakuli, P.S.- Chapra Muffasil, District- Saran At Chapra Versus The State Of Bihar ---------------------------------- 02. 12.01.2012. Heard Mr. Manish Kumar Singh, learned counsel for the petitioner and Mrs. Indu Bala Pandey, learned A.P.P. for the State. The present application has been filed for grant of bail to the petitioner under the provisions of the Juvenile Justice(Care and Protection of Children)Act, 2000. Earlier the prayer for bail had been rejected by the Juvenile Justice Board, Saran at Chapra by order dated 19.08.2011 in Juvenile Enquiry No.282 of 2011, G.R.No.1411 of 2011 and the appeal filed was also dismissed by order dated 12.09.2011 passed in Criminal Appeal(Juvenile)No.58 of 2011 by the 2nd Additional Sessions Judge, Saran at Chapra. The petitioner is accused in Janta Bazar P.S.Case No.25 of 2011 for offence under Section 392 of the Indian Penal Code. The FIR was registered against unknown persons but only on suspicion the petitioner 2 has been arrested. Learned counsel for the petitioner submits that the petitioner has been declared to be a juvenile and only on suspicion he has been made accused in the present case. Learned counsel also submits that another co-accused, namely, Sonu Singh alias Priyanshu Shekhar Singh has already been released on bail by the Sessions Judge, Saran by order dated 13.12.2011 in Cr.(Juvenile)Appeal No.82 of 2011. A copy of the order has been produced and is kept on record. Learned counsel also submits that the petitioner is in custody since 12.05.2011. Considering the facts and circumstances of the case, let the petitioner, namely, Manish Kumar Singh be released on bail upon furnishing bond of Rs.5,000/-(five thousand) with two sureties of the like amount each to the satisfaction of Juvenile Justice Board, Saran at Chapra in connection with Janta Bazar P.S.Case No.25 of 2011 arising out of G.R.No.1411 of 2011. One of the bailors should be the father of the petitioner shall also execute 3 a bond of good behaviour with regard to the petitioner. The petitioner shall also present himself physically before the Probation Officer, Saran at Chapra once a month and also as and when directed by him. The Probation Officer, Saran at Chapra shall maintain strict supervision over the petitioner. This application is accordingly disposed off. B.Kr. ( Ahsanuddin Amanullah,J.)
