patna high court cr.misc. no.3462 of 2012 (2) dt.24-01-2012 in the high court of judicature at patna criminal miscellaneous no.3462 of 2012 ====================================================== rajesh singh .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== appearance : for the petitioner/s : mr. ramesh kumar singh, adv. for the opposite party/s : none ====================================================== coram: honourable mr. justice aditya kumar trivedi oral order (per: honourable mr. justice aditya kumar trivedi”24. 01-2012 heard learned counsel for the petitioner. the state is absent. father of anita devi filed a written report disclosing therein that in the pretext of fulfillment of demand of dowry by way of providing a motorcycle, she was tortured and lastly was ousted from her sasural. it has further been disclosed that on earlier occasion petitioner had terminated her pregnancy. it has been contended that instant case has been filed in retaliation of matrimonial (divorce case no.39/2011) which was filed on 4.4.2011 on the pretext of adultery. also submitted that petitioner is in custody since 25.10.2011. in the aforesaid facts and circumstances of the case, petitioner, rajesh singh is directed to be released on bail on furnishing bail bond of rs.10,000/- with two sureties of the like patna high court cr.misc. no.3462 of 2012 (2) dt.24-01-2012 amount each to the satisfaction of chief judicial magistrate, araria in connection with narpatganj p.s. case no. 215 of 2011, g.r. no.1746/2011.
