The petitioner is in custody in connection with Khizersarai P.S. Case No. 61 of 2011 for offence punishable under Sections 302/34 of the Indian Penal Code, although charge sheet has been submitted under Section 306 of the Indian Penal Code. The petitioner is not named in the F.I.R. which was instituted on the basis of the fardebeyan given by mother of the accused in the Appolo Burns Hospital at Patna. Learned counsel for the petitioner submits that though the name of the petitioner does not find mention in the F.I.R. but by reason of statement made by some witnesses during the course of investigation alleging altercation between the couple prior to the alleged occurrence that the name of the petitioner has been roped in the present proceedings. Annexure-2 series certifies that the death of the deceased took place in the hospital Patna High Court Cr.Misc. No.37332 of 2011 (3) dt.24-01-2012 by burn injuries during the course of treatment. Taking into consideration the submission of learned counsel, let the petitioner Sanjay Sao be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizersarai P.S.
