24. 01-2012 Issue notice to the respondent no.5, against whom this I.A.No. 7924/11 under Order 39 Rule 1 & 2 C.P.C. has been filed praying for restraining him from constructing the pucca house over the land in dispute i.e. over Khata No. 153, Khesra No. 575 Area 6 Katha, during the pendency of this appeal, to show cause as to why the respondent no.5 be not restrained from making any construction over the suit land during the pendency of this appeal. The appellants must file requisites both under registered cover with A/D as well as ordinary process within one week, failing which this application shall stand rejected without further reference to the bench.
