.....coram: honourable mr. justice akhilesh chandra oral order (per: honourable mr. justice akhilesh chandra”24. 01-2012 heard learned counsel for the petitioner and learned counsel for the vigilance. petitioners are named accused in this case with allegation of obtaining degree without attending classes during due academic session. submission is that petitioners were admitted to the institution at belated stage without any direction or undertaking to attend the classes up to a particular extent and were also duly permitted to appear at the examination which they did and ultimately, qualified. degree obtained by them have already been declared valid by orders of honble calcutta high court. considering the facts and circumstances, the petitioners, in the event of arrest or surrender within four weeks 2 from today, are directed to be enlarged on bail on furnishing bonds of rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the special judge, vigilance-ii, patna, in vigilance p.s. case no. 06 of 2000, spl.case no.10 of 2000, subject to the conditions laid down in section 438(2) of the code of criminal procedure with additional condition that the petitioners shall remain present before the court below on each and every date till disposal of the case. in case of failure to remain present on two consecutive dates without reasonable explanation, the privilege granted shall be deemed to be cancelled. Petitioners are named accused in this case with allegation of obtaining degree without attending classes during due academic session.
