IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.37625 of 2011 Vikash Prasad Sao Versus The State Of Bihar --------”

24. 01-2012 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 25.3.2011 passed in Cr. Misc. no. 42595/2010 by passing the detailed order. The learned trial court has reported that out of 16 prosecution witnesses up till now, only four prosecution witnesses have been examined and 12 prosecution witnesses are still left to be examined. The learned trial court has sought six months time for disposal of the case of the petitioner. Taking into consideration the aforesaid facts and circumstances as well as this aspect of the matter that the petitioner is husband of the deceased and there is specific allegation against him that he set the deceased on fire, I am not inclined to release the petitioner on bail. Accordingly, his prayer for bail in connection with Nagar Nawada P.S. Case no. 143/2010 arising out of Sessions trial no.660 of 2010/116 of 2010 pending in the court of Fast Track Court IV, Nawada is again rejected.
