24. 01.2012 Heard Learned counsel for the petitioner as well as learned A.P.P. Parshuram Singh, driver of truck bearing Registration not BR- 1-G-8340 while was engaged in loading sand over his truck, eight miscreants in two stages came, made indiscriminate firing causing injury to him along with Ram Pravesh Kumar, Sanjeev Kumar and Santosh Kumar out of whom, Santosh Kumar died in course of treatment. It has been submitted on behalf of petitioner that as none were named in the FIR therefore case was registered against unknown. From the order impugned it is evident that all the witnesses have supported the manner of occurrence but none of them named any of the miscreants. The Investigating Officer only to complete paraphernalia apprehended some persons and got an imaginary extra judicial confessional statement recorded in the case diary to justify their apprehension. Even taking into account the aforesaid event, petitioners name has cropped up from the extra judicial confessional statement of Pintu Kumar and Kaushal Singh @ Sarha.
