24. 01-2012 Petitioner is apprehending his arrest in a case registered for the offences under Sections 121(A), 122, 414, 120B/34 of the I.P.C. and Section 17 of the Criminal Law Amendment Act. According to the prosecution case stone chips loaded truck was seized by the informant and five persons sitting in the cabin of the truck were apprehended. Explosive substances kept in gunny bags were found concealed under the stone chips. It is submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R. but his name subsequently sprang up on confession of the co-accused moreover no recovery has been made from the possession of the petitioner and above all he has never been involved in any other case of similar offence. Considering the aforesaid facts, let the petitioner namely Sabal Singh, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsarif in connection with Deep Nagar P.S.
