24. 01-2012 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband is apprehending her arrest in a case registered under Sections 304(B) and 201/34 of the Indian Penal Code. The accusation is of killing the victim for non-fulfillment of dowry demand. It is submitted that the informant has admitted in the F.I.R. that the marriage was performed nine years prior to occurrence. Hence, the case does not come within the purview of Section 304(B) of the I.P.C. Considering the aforesaid submissions, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Mohania P.S. Patna High Court Cr.Misc. No.2297 of 2012 (2) dt.24-01-2012 Case No. 105 of 2011 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kaimur(Bhabua), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J.) U.K./-
