24. 01-2012 Heard learned counsel appearing on behalf of the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Atri P.S.Case No.106 of 2009 for the offence punishable under section 364/34 of the Indian Penal Code. The name of the petitioner has transpired on the basis of the confessional statement made by the main accused Bhutto Ansari. Learned counsel for the petitioner, with reference to order dated 11.3.2010 passed in Cr.Misc.No.7541 of 2010, order dated 16.3.2011 passed in Cr.Misc.No.42325 of 2010 and order dated 5.1.2012 passed in Cr.Misc.No.451 of 2012, submits that three of Patna High Court Cr.Misc. No.34896 of 2011 (3) dt.24-01-2012 2 the co-accused, namely, Rambriksh Yadav alias Loha Singh, Rajesh Prasad Yadav alias Rajesh Kumar Yadav and Baudhu Yadav respectively, whose cases are similarly placed as that of this petitioner, have since been granted bail by this court. He thus submits that the case of the petitioner, who is aged about 65 years, and has a clean antecedent, stands on similar footing. Regard being had to the submissions of the learned counsel, let the petitioner Munni Yadav be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Atri P.S.Case No.106 of 2009. ahk (Jyoti Saran, J.)
