24. 01-2012 Heard learned counsel for the petitioner and learned Additional P.P. for the State. Informant, Uday Narayan Rai gave his Fardbeyan disclosing therein that Pappu Kumar took away his son, Manoranjan Kumar. After some time, he heard sound of fire. He proceeded towards that direction and found his son in pool of blood. His younger brother, Pritam Narayan disclosed that as per information conveyed by Pappu Kumar over mobile, Jaipal Rai, Krishna Rai, Rahul Kumar, Hemant Kumar along with one unknown came over motorcycle and on an order of petitioner, Jaipal Rai, Krishna Rai and Pappu Kumar caught hold and Rahul Kumar and Hemant Kumar shot which proved fatal. It has been submitted that from the order impugned it is evident that the occurrence even accepting in its entirety for Patna High Court Cr.Misc. No.3473 of 2012 (2) dt.24-01-2012 the arguments sake, took place as the deceased had an access with a female member of petitioners family apart from having allegation of an order giver. Taking into account the part played by the petitioner, being not an assailant, petitioner, Jaipal Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Mufassil P.S.
