patna high court cr.misc. no.2280 of 2012 (2) dt.24-01-2012 in the high court of judicature at patna criminal miscellaneous no.2280 of 2012 ====================================================== kaushalya devi .... .... petitioner. versus the state of bihar .... .... opposite party. ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”24. 01-2012 heard learned counsels for the petitioner and the state. the petitioner being the mother of husband is apprehending her arrest in a case registered under sections 302, 328 and 201/34 of the indian penal code. the accusation is of killing the victim for non-fulfillment of dowry demand after nine years of marriage. there is general accusation against the entire in-laws family including the petitioner but it appears from annexure-2 that the husband has been charge sheeted whereas investigation is pending against the petitioner. admittedly, the informant is not witness to actual occurrence. considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the patna high court cr.misc. no.2280 of 2012 (2) dt.24-01-2012 learned court below within a period of twelve weeks from today in connection with sarmera p.s. case no. 47 of 2011 on furnishing bail bond of rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned c.j.m. nalanda, subject to the conditions as laid down under section 438(2) of the code of criminal procedure.
