Petitioner is in jail custody since 6.9.2011 in a case registered under section 364A of the IPC. Learned counsel for the petitioner submits that, as a matter of fact, informant had taken money from the petitioner and when the petitioner demanded his money, informant lodged this false case. It is further contended by him that the petitioner does not have any criminal antecedent and he was not aware of the institution of the present case. Taking into consideration the aforesaid submissions as well as this aspect of the matter that informant has returned to his home safely, let the petitioner, Santosh Kumar Singh, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Chhatauni P.S.
